Diaspora Freedom Initiative, LLC Affiliate Referral Program Terms & Conditions
Effective Date: June 1, 2025
Welcome to the Diaspora Freedom Initiative, LLC Affiliate Referral Program. These Terms & Conditions (the “Agreement”) govern your participation as an affiliate in our referral program. By enrolling or continuing as an affiliate, you agree to abide by the terms outlined below.
1. Affiliate Enrollment
Open Registration: Visitors to our website may register as affiliates through our online registration form
Approval Process: All registered affiliates are subject to review and approval by DFI management
Eligibility: Affiliates must be 18+ years of age and legally able to enter into binding agreements
Business formation and Prime Contractor Advantage Program services
Commission Rate: 6% of total contract value for qualifying services Minimum Investment Threshold: $6,000 minimum client investment level required for commission eligibility
3. Commission Calculation & Payment Terms
Commission Base: Calculated on total signed contract value, excluding applicable taxes and government fees
Commission Trigger: Earned upon client’s execution of service agreement and initial payment receipt
Payment Schedule: Commissions paid within 30 days of service agreement execution
Payment Method: Direct deposit or international wire transfer
First-Time Clients Only: Commissions apply only to new client relationships, not repeat services or upgrades
4. Tracking & Attribution
30-Day Cookie Window: Referrals tracked for 30 days from initial link click
Attribution Priority: First-click attribution model for multiple referral sources
Manual Attribution: For offline referrals, client must mention affiliate name during initial consultation
5. Service Completion & Refund Policy
Refund Impact: If client receives full refund within 30 days of service agreement, corresponding commission will cancel affiliate payments
Partial Refunds: Commission adjustments made proportionally to refunded amounts
Service Modifications: Commission based on final executed contract value
6. Affiliate Conduct & Compliance Requirements
Affiliates must:
Accurately represent DFI services and pricing levels
Disclose affiliate relationship to prospects
Maintain confidentiality of all client information
Comply with applicable advertising and referral laws in their jurisdiction
Affiliates must not:
Misrepresent DFI or its services
Use spam, misleading advertising, or false claims
Engage in cookie-stuffing or forced redirects
Offer competing relocation, trust, or immigration services
Share proprietary DFI methodologies or client information
DFI Authority & Program Management:
Final Investment Determination: DFI retains discretion in determining qualifying services and eligible investment levels for commission purposes, exercised in a commercially reasonable manner
Program Removal Authority: DFI may remove affiliates from the program for cause, or without cause subject to applicable law and with reasonable notice where required
Commission Determination: Commission calculations follow established program terms, with disputes subject to the resolution process in Section 14
Violation Consequences:
First violation: Written warning and mandatory compliance review
Repeated violations: Immediate termination from affiliate program
Commission Forfeiture: Violators forfeit all unpaid commissions and may be required to return previously paid commissions related to fraud or material misrepresentation within 12 months of payment
Permanent Ineligibility: Terminated affiliates are permanently ineligible for future participation in DFI affiliate programs
Investigation Process: DFI reserves the right to investigate suspected violations and may suspend commission payments during investigation periods. Affiliates will be notified of investigations and given opportunity to respond before final determination.
7. Intellectual Property & Confidentiality
All DFI marketing materials, processes, and client information remain DFI property
Affiliates may use provided marketing materials but may not modify without written permission
Client information and referral details must be kept strictly confidential
8. Tax Responsibilities
Affiliates responsible for all applicable taxes on commission income
DFI will issue 1099 forms for US affiliates earning $600+ annually
International affiliates responsible for compliance with local tax requirements
9. Program Modifications & Termination
DFI Rights: May modify commission rates, terms, or terminate program with 30 days written notice, subject to applicable law
Immediate Termination: DFI reserves right to immediately terminate for material violations of this Agreement
Outstanding Commissions: Earned commissions paid according to normal schedule upon termination
10. Geographic & Market Restrictions
No territorial restrictions unless specified in writing
Affiliates may not target clients in jurisdictions where DFI services are not available
Compliance with local referral and advertising laws required
11. Limitation of Liability
DFI is not responsible for indirect, special, or consequential damages, or loss of revenue, profits, or data arising from this Agreement or the Affiliate Program. Total liability limited to unpaid commission amounts.

14. Dispute Resolution
Any disputes arising from this Agreement shall be resolved through mediation in Kenya, consistent with DFI’s standard dispute resolution procedures. Affiliates agree to attempt good faith resolution for 14 days before initiating formal proceedings.
